The Tee Clip™ product is licensed by the patent owner (Shane Wieters) to Lost Wedge, LLC and may also include branding, logos, and trademarks. Lost Wedge, LLC has the right to manufacture, sell, and relicense the product to other companies for their branding, subject to separate agreements and patent owner approval.

If you submit any content to the Website, including reviews, comments, and feedback, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

8.1 Assumption of Risk and Proper Use. You acknowledge and agree that the Products are intended solely for ordinary, lawful golf-related use. You assume all risks associated with the purchase, possession, handling, and use (including misuse) of the Products. This includes, without limitation, the risk of personal injury, property damage, or death arising from any use or misuse of the Products, whether intentional, negligent, accidental, or otherwise. Examples of such risks include, but are not limited to: poking, stabbing, or otherwise injuring yourself or others with golf tees or divot tools; swallowing, choking on, or ingesting ball markers or any small components; any form of self-harm; and any injury resulting from common-sense hazards, improper handling, or use of the Products in any manner other than their ordinary intended purpose.

8.2 Release and Waiver. To the maximum extent permitted by applicable law, you hereby irrevocably release, waive, discharge, and hold harmless Lost Wedge, LLC, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, demands, causes of action, damages, losses, costs, and expenses (including reasonable attorneys’ fees) of any kind or nature, whether known or unknown, arising out of or relating to any injury, harm, damage, or loss sustained by you or any third party in connection with the Products, including any injury resulting from use, misuse, abuse, or any other handling of the Products in any capacity, shape, or form.

8.3 Limitation of Liability. In no event shall Lost Wedge, LLC or its affiliates be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (i) your use or inability to use the Website; (ii) any unauthorized access to or use of our secure servers and/or any personal information stored therein; (iii) any interruptions or cessation of transmission to or from the Website; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Website by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Website; or (vi) any injury, harm, damage, or loss of any kind arising out of or related to the purchase, possession, use, misuse, or handling of any Products, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not Lost Wedge, LLC has been advised of the possibility of such damages.
